A compliance officer sits across from a department head. A patient has filed a complaint. The AI-assisted note didn't match what they remembered from the visit. "Show me how this decision was made." The room goes quiet. The logs show timestamps. Confidence scores. A signature. But no one can explain how the system reached its conclusion. That question gets asked eventually. In a deposition. In a board review. In a regulator's office. Given that most AI systems are currently embedded in healthcare workflows, the answer remains unknown. This is not a problem of the future. It is a problem of the present. We call it a governance failure. THE ILLUSION OF OVERSIGHT Health systems are reassured by dashboards, logs, and vendor assurances. It is timestamped. It has confidence scores. It has audit logs. But these are not audit logs. An audit log is not proof that a system ran. It demonstrates that a system's decision-making process can be reconstructed step by step by an observer not involved in the process. Most AI tools in healthcare cannot do this. Large language models generate outputs in a probabilistic manner. They do not preserve reasoning. They do not have a chain of inference that withstands the test of time. When a clinician electronically signs an AI-assisted note, the system lacks the ability to display: Which information was the most influential. Which options, if any, were evaluated. Justification for an output versus another. The extent of AI versus human contribution. The system functioned properly. The decision was made. The explanation was lost. That is the illusion. WHEN "HUMAN IN THE LOOP" BECOMES RISK TRANSFER Human in the loop sounds nice. It sounds like there is consideration. It sounds like there is responsibility. However, human-in-the-loop does not equate to human comprehension. If a clinician looks at AI output with no idea what information the model used, what it skipped, what data it was uncertain about, then, to all intents and purposes, they are not in control of the system. They are absorbing the risk. When that decision is later challenged, the model remains silent. The vendor points to the disclaimers. The logs show what was done, not the rationale. The record will show a signature, and that will be all that is left. DISCOVERY IS WHERE THIS BREAKS None of this feels urgent until discovery begins. A malpractice lawsuit. A question for a regulator. A board-level investigation. A subpoena. Once the evaluation is done, the focus shifts from performance to provenance. What information was accessible at the time the process was performed? What role did the AI play? What protections were in place? What type of verification occurred? Most businesses engage in guesswork in responding to these questions. There is a lack of reasoning in the logs, and there is a lack of justification in the confidence scores. Vendor promises do not hold up against sworn testimony. THE DEFICIT OF ACCOUNTABILITY IN AI ADOPTION The gap between AI adoption and AI accountability is real and quantifiable. A 2025 Black Book Research survey conducted among 182 US hospital leaders found: 22% of respondents stated they were confident in their ability to create a detailed and complete auditable explanation for some AI to be described within a 30-day period to regulators or payers. 44% stated they lacked confidence in their audit readiness. For 2026, the average predicted budget for AI governance and safety is 4.2% of the total IT budget plus the Quality/Safety budget. 29% of respondents stated they have developed and are enforcing policies regarding AI model inventory, AI model governance, AI model lineage, and AI model sign-offs. Almost 50% of respondents indicated they are drafting policies. 41% stated that the lack of explainable documents from the model vendors, such as the model card and the model drift report, is the biggest obstacle to the audit. 37% of respondents stated they have not documented all the inputs and the versions of the models. 33% stated lack of internal clarity regarding IT, Quality/Safety, and Compliance is a bottleneck for governance progress. The adoption curve remains steep. The governance curve is practically flat. That gap is where liability resides. WHAT LEADERS NEED TO DO NOW Name one owner. No committees. No working groups. One executive accountable for AI usage, governance, documentation, and legal defense. Diffuse ownership is how governance debt accumulates. Know what you have. Create a genuine inventory of AI in use. Embedded features, vendor side offerings, pilot tools, unofficial workarounds. Governance cannot function in blind spots. Design for failure. Patients will say no. Clinicians will question outputs. Adverse events will occur. A system can improve efficiency and still fail under scrutiny. Governance that presumes everything will go well is not governance. Retrofitting governance will always cost more than building it in. Preserving trust takes far less time than rebuilding it. Imagine your organization needs to justify an AI-driven decision tomorrow, step by step, under pressure. Would it be able to do so? Not vaguely. Not using policies. Not using vendor slides. If the answer is no, the risk is already present.
